Bylaws

 

1. Recruitment, trial period

 

1.1
Anyone is welcome to join the Cartoon General, provided they respect the following bylaws and the mission statement of the clan.

 

1.1.1
All applicants must be at least 18 years of age.

 

1.1.2
In some cases the age requirement can be disregarded, a majority vote from the Council and/or Command Staff is required.

1.2
People interested in joining the clan should post in the Recruitment Center the appropriate form. The more they tell us about themselves, the more likely they are to be accepted in the clan.

 

1.3
All applicants must demonstrate a good attitude and friendly personality, as in joining the Cartoon Generals they will become our representative in any games they play and their conduct and behavior will be under close scrutiny.

 

1.3.1
By applying to join the clan, potential new members are assumed to have read, understood and agreed to the rules in these by-laws, ignorance of the rules will not excuse poor behavior.

1.4
Prospect Phase, trial period.

 

1.4.1
Once accepted for trial period, all new members will be referred to as Prospects

 

1.4.2
All new Prospects are required to wear a .pro tag at the end of their in-game name (steam name or player profile), along with the appropriate clan tag in-game. (ex: =GEN=Newguy.pro)

 

1.4.2.1
In games with built-in modifiable rank system, they should be assign the rank Prospect.

 

1.4.2.2
In games with editable player name, the Prospect should edit his name to add the .pro

 

1.4.2.3
Clan Tag shall be =GEN=, when applicable.

 

1.4.2.4
In games where none of the above is possible, no changes are required.

1.4.3
The Prospect period will last at least one (1) month.

 

1.4.3.1
The Orientation Office staff can extend for one (1) additional month the duration of the trial phase of any Prospect, if they did not have the time to finish the orientation of the member or if his Neutral/Abstain numbers in his vote poll are above 70%. This is entirely optional and up to the Orientation Officers OIC/2IC choosing. Alternatively they can request the member to be dropped because of lack of activity.

 

1.4.3.2
At the end of the additional 30 days of trial period in situation described above, the vote is conducted as describe in 1.4.5 no additional extensions are possible.

1.4.4
During their Prospective period, prospects cannot vote on new membership of other Prospects. They do however, have the right to cast their vote on any matters open in the Parliament Square.

 

1.4.5
One the prospective period is over the entire clan will have a chance to express "
any valid reason to object to the admission of this prospect in the clan
" in the form of a poll. Any member having a reason is expected to explain it by replying to the thread where the poll is located.

 

1.4.5.1
Poll results interpretation.

 

1.4.5.1.1
"Yes" votes signifies that a current full member has "
a valid reason to object to the admission of this prospect in the clan
" and is expect to express his reasons.
Any "Yes" votes not accompanied with a reason will be disregarded.

 

1.4.5.1.2
"No" votes signifies that there is no issues with the members.

 

1.4.5.1.3
"Neutral/Abstain" should only be used in cases where the members did not have any contact with the Prospect.

1.4.5.2
If any valid reason to bar the prospect from membership is presented, the Orientation office will investigate the validity of the problem by meeting with the dissenting member(s) as well as the prospect in question if needed.

 

Personal differences are to be expected from time to time, but a single member having a personality clash with a prospect is not a reason to deny membership. In the event that
15%
or more of current active members have a valid reason to want to deny membership to a prospect (multiple members having personality clashes with a prospect would be a cause for concern), then the prospect shall be denied membership into the clan without having the matter brought to the Council.

 

Any serious valid concern with a prospect will be investigated by the Council and Orientation office and may result in the prospect being denied membership even if the prospect has fewer than
15%
dissenting votes.

 

In any other cases including those with less then
7%
of validated objections without any of them serious, Prospect is accepted as a full member automatically.

 

1.5.3.2.1
A member wishing to discuss his objection privately can contact a member of the Orientation Office, but must reply to the thread indicating he objects, state the general nature of the objection and must include who he contacted in the orientation office and how!

1.5.3.3
If the prospect is granted entry in the clan, the poll must be moved into the archives before his rights and status are updated, thus guaranteeing any discussions concerning the Prospect would not be seen by the Prospect in question. Ensuring privacy and confidentiality to our members is a priority.

 

2. Communication

 

2.1
In order for this clan to work properly, communication is vital. Just as we expect people to be honest, we feel it is important that our members are able to express their feelings and thoughts to each other. All our members communicate regularly through a number of means, including but not limited to, our website forum and TeamSpeak.

 

We expect you to check the forum regularly for news, clan announcements and general updates, and we expect you to use TeamSpeak when possible if you are ingame.

 

2.1.1
It is expected that all members have the TeamSpeak client installed.

 

2.1.2
While playing games, members are expect to be in Teamspeak and in the appropriate channel.

 

2.1.3
Members must visit the forums regularly, read announcements and vote when required

2.2
When playing official matches, attending practice or on clan communication channels (including IRC or Steam Friends), it is expected that you will use your known name and the appropriate clan tag (including, if applicable, the trial ".pro" end-tag).

 

3.Teamwork, Fair Play, Clan Activity and Dual-Claning

 

3.1
As a member of the Cartoon Generals you are expected to - at all times - act as an ambassador for the clan. This means that your behaviour must at all times reflect the values of the clan. This goes beyond your attitude and friendliness towards other clan members and members of the public and extends to how you play on clan servers.

 

3.2
As a clan we are more interested in playing games to enjoy them and work as a team than for anybody's individual personal glory. This means that we expect members to play for the team regardless of if they are playing in a scrim, a match or on a public server. So long as you are representing the clan, you should always carry our values with you.

 

3.3
Cheating is something that we as a clan will not tolerate. If it is discovered that you are using cheats, you will be expelled from the clan immediately.

 

3.4
Dual-Claning

 

3.4.1
For FPS, no dual-clanning is tolerated for games officially supported by the Cartoon Generals

 

3.4.2
For MMO's members are free to do as they wish, when wearing GEN tag members are expected to follow our bylaws.

 

3.4.2.1
For MMO clan events, raids, landings and such, priority will be given to members wearing =GEN= tags and that are committed to the Cartoon Generals in that game.

 

3.4.2.1
It is implied by the above that you cannot switch tags just to gain priority for an events

 

4. Server Payments

 

4.1
In order to maintain clan servers for public usage, scrims and matches, we have to pay a considerable amount every month. This amount is not paid by any single individual but is instead spread out amongst all members donations.

 

4.2
Voluntary contributions towards a 'game server' drops too low to cover the cost of renting, then servers with low activity would be the first to be dropped, although this won't happen without being announced in advance, so as to give clan members an opportunity to pay towards it if they feel it is worth keeping.

 

5. Disciplinary Actions, Dismissal or Leaving the clan

 

Although the clan is and always will remain a group of friends first, and a social club second, it cannot exist without the rules discussed above. As such, it must be remembered that breaking these rules will not be without consequences. All members are considered not-guilty until proven otherwise. The Spirit of fair play and respect will not diminish due to lack of rule inclusion. These rules are simply there in event they would be required!

 

5.1
The following offences are considered gross misconduct and can be punishable by immediate dismissal from the clan by vote of the Toontown War Council members and/or Command Staff:

 

  • Use of aimbots, cheats, hacks or any code which is considered illegal in professional gaming circles
  • Use of map glitching or clipping errors to gain an advantage.
  • Being found to be a 'mercenary' (discussed in detail above)
  • Being found to have lied about your age when a member joined the clan, regardless of their current age
  • Failure to take part in clan activities for 13 weeks without first announcing their intention to take a break
  • Repeated severe bad behaviour in contradiction to the rules stated above concerning teamwork, fair play and mutual respect
  • Posting or reproducing internal clan information from any private area of the forum to individuals or other websites outside the clan without express permission or arrangement with the Towntoon War Council
  • Posting, reproducing or copying clan logos or art work created by the Animation Studio to individuals or other websites outside the clan without express permission or arrangement with the Towntoon War Council or the Animation Studio.

 

5.2
A vote for dismissal can be called by the Council in cases of gross misconduct, by request of the Command Staff or when the situations demands it.

 

5.2.1
A unanimous (100%) decision must be reached by the Council to dismiss a member.

 

5.2.1.1
This vote will run for no less then seven (7) days, unless unanimity is reached.

 

5.2.1.2
If they choose to do so or cannot reach unanimity, the vote can be submitted to the Command Staff

5.2.2
A three-fifths majority (60%) must be reach by the Command Staff to dismiss a member .

 

5.2.2.1
This vote will run for no less then seven (7) days, unless absolute majority is met.

 

5.2.2.2
If they choose to do so or cannot reach the required majority the command staff can move up the matter to a clan wide vote.

5.2.3
A simple majority (50% +1) must be reach by the entire membership to dismiss a member.

 

5.2.3.1
This vote will run for no less then ten (10) days, unless absolute majority is meet.

5.2.4
The Council may choose to skip any of the above steps and go strait to a Command staff or Clan wide vote when necessary.

 

5.2.5
Members dismissed by a Council only vote, can request that the Command Staff validate the decision.

 

5.2.6
During the proceedings, a thread will be made on the forums stating the reasons for the requested removal including all accusations of wrong doing, and any evidence to support this.

 

5.2.6.1
The member subject in proceedings will have the right to rebuttal.

 

5.2.6.2
No language abuse, trolling or flaming will be tolerated during the proceeding. Only facts should be presented, there is no place for personal biases and other unnecessary distraction from the process.

 

5.2.6.2.1
If such infractions are committed and/or continue against advisement the Toontwon Sheriff Dept. or Command staff may have to remove from view parts of threads and/or temporally ban a member in extreme circumstances. This is with sole purpose to ensure fairness and respect during the proceedings.

5.2.7
Any resulting dismissal from one of the above proceeding is final, with the exception stated above

 

5.2.8
At any moment during these proceedings, a member may choose to resign, thus ending the proceedings.

5.3
Toontown Sheriff dept. Personnel will have the authority to act in reaction to any offence committed by our members, the actions should be limited to kick / temp bans or less until the Toontown Sheriff dept. staff can review that said offence. In most cases just a conversation with the offending member should be enough to resolve most issues. We are here to have fun, this should be kept in mind!

 

5.3.1
When the Toontown Sheriff dept. receives a complaint against a member or witness one of our members is breaking our bylaws or server rules the Toontown Sheriff dept. will conduct an investigation. If they find proof of such an infraction it will be resolved in the steps describe below with the exception of gross misconduct (see 5.1).

 

  • 1st offence: The member is reminded of our rules and his infraction is expained.
  • 2nd offence: Written warning where is his infraction is expained.
  • 3rd offence: Written warning. Admin rights of the offending member are suspended for a period of no less then one (1) week and no more then two (2) months. In addition the member cannot attend scrim and special clan events for no less then one (1) week and no more then one (1) month. A temporary ban may be added when applicable, for no longer then one (1) week on the server where the infraction took place.
  • 4th offence: Suspension from servers and all clan activities for up to one (1) month or dissmisal from the clan.

 

5.3.2
In cases involving server rules only the infraction of the past two (2) months can be taken in consideration in the application of the disciplinary steps described in 5.3.1. (Not applicable in games we do not host directly)

 

5.3.3
Any member who for period of one (1) month displays good conduct see it's disciplinary step progression reduce by 1 step.

 

5.3.4
Any member who for period of three (3) months displays good conduct has his disciplinary step progression reset to zero.

 

5.3.5
In cases involving Prospect(s), all infraction from their probationary period can be taken in consideration in the application of the disciplinary steps regardless of 5.3.3. Also any action described as gross misconduct (see 5.1) involving a Prospect can result in immediate expulsion from the clan without the possibility of appeal .

5.4
If a member leaves the clan, either willingly or because of dismissal, all donations will remain with the clan account.

 

6. Decision-Making

 

Although the Cartoon Generals are for the most part a friendly and democratic clan, in order to ensure the security of the clan finances, website and servers, an element of hierarchy is necessary. This is for the most part redundant, as almost all important decisions will be dictated either by this charter or by majority consensus with all clan members having equal say. However, there are certain decisions which the top level of clan members will have supreme authority to dictate, which include but not limited to:

 

  • Transferral of clan bank account payments to clan service providers
  • Transferral of clan bank account funds to reimburse members if the clan should be dissolved. (by pro rata of their total donations)
  • Final decisions over service provision and location for game, website hosting and supported games
  • On matters regarding the bylaws, rules and regulations
  • In crisis when immediate attention is required
  • Situations not covered by the present bylaws

6.1
When any matter is subject to a clan vote, each member shall have one vote, and no member is allowed to vote on behalf of another member. No veto rights will exist.

 

6.2
Any vacancy on the Toowntown War Council will prompt a special election. Anyone having completed successfully their thirty (30) day probation can submit their candidacy. In addition to be accepted the candidate must not have been found guilty of any gross misconducts in the two (2) months prior the election.

 

The deadline for applicants shall be seven (7) days. Then, the current Toowntown War Council will evaluate the candidate and make their recommendation on the best(s) candidates. They may take up to three (3) days to make their analysis. Then on the tenth (10) day of the special election a official vote shall be posted to all members in "Parliament Square". The ballot shall include all candidates, their current position or duties, the number of seats open and the recommendation of the Toowntown War Council. The vote shall remain open for seven (7) days. The members with the most votes gets appointed to the Council. In the event where multiple seats are open, the runners up in order of votes get the seats. The result of the poll shall be available to the members at all times.

 

6.2.1
With growth the need for more personnel will arise. If the current Toowntown War Council feels it needs to grow and thus create new seats on the Toowntown War Council, the council will announce their desire to add seats to the council, a vote shall be carried out in "Parliament Square" to determine if the majority of the clan agrees. The vote shall remain open for seven (7) days. If the vote is successful, a special election (6.2) will be carried out.

 

6.3
Bylaws modification proposal can be presented to the Command Staff for approval.

 

6.3.1
Bylaws changes will be voted on in form of a poll.

 

6.3.1.1
This poll will be open for no less then seven (7) days.

 

6.3.1.2
It will always include an option : "Changes to the proposal are needed (please comment)"

 

6.3.1.3
A qualified three-quarters majority (75%+1) is needed for a modification to be adopted in a Command Staff vote.

6.3.2
Any such proposal will always be accompanied with a secondary poll (within the same topic) to determine if the Command Staff feels the entire membership should determined the fate of the proposal at hand.

 

6.3.2.1
If a three-fifths majority (60%) of the command staff feel a modification should be presented to the entire clan for it's adoption, the decision is then conferred to clan members notwithstanding the results of the primary poll of the Command Staff.

6.3.3
If or when a bylaws modification proposal is to be presented for a clan wide vote, it must be done in Parliament Square.

 

6.3.3.1
This poll will be open for no less then seven (7) days.

 

6.3.3.2
It will always include an option : "Changes to the proposal are needed (please comment)"

 

6.3.3.3
A two-thirds majority is required for a modification to take effect when the vote goes clan wide notwithstanding comments, where
the number of votes
in favor must be at least twice
the number of
votes against
.

 

7. Motion of no confidence

 

Any member Cartoon General with the exceptions found below in article 7.8, can challenge a current Council Member with sufficient proof that that said council member is neglecting his responsibilities severely to a point where it is detrimental to the clan, that his actions are adverse to the good of the clan or that he has grossly violated the mission statement or bylaws in a undeniable way. This process is referred to as a motion of no confidence.

 

7.1
Such a desire to challenge a council member, therefore calling a motion of no confidence, must be express in writing to a member of the Toontown Sheriff Dept.

 

7.2
Any Toontown Sheriff Dept. personnel upon receiving a request for motion of no confidence will open a case by starting a thread on the forums in their office.

 

7.2.1
All sheriff's will help to gather all the relevant information, interview the people involved and find any evidence that needs to be presented to the command staff for review. Thus ensuring that personal differences, petty quarrels or popularity are not the motivation for such request. This will be done within the limits of their acess, duties and responsibilities.

 

7.2.2
False pretenses, lies or motions presented for personal gain may be regarded as gross misconduct and can be acted upon accordingly.

7.3
The Toontown Sheriff Dept. will present their findings to the Command Staff who will review them and will determine if the motion is justified.

 

7.3.1
During the proceedings the arraigned Council member shall be given an opportunity to honorably face his accuser. Thus given an opportunity to present his version of events.

 

7.3.2
A three-quarters majority (75%+1) vote of the command staff is required for a motion to be deemed valid. It must then be ratified by the full membership.

 

7.3.3
This vote will run for no less then seven (7) days, unless absolute majority is met.

 

7.3.4
The subject of a motion of no confidence is not allowed to vote on their on case.

7.4
Any motion found to be valid must be presented to the entire membership for it's ratification in form of a vote.

 

7.4.1
A two-thirds majority is required for a no confidence motion to pass, notwithstanding comments,
where the number of votes
in favor of the motion must be at least twice
the number of
votes against
.

 

7.4.1.1
Abstaining votes or neutral votes are not considered in the results!

7.4.2
This vote will run for no less then ten (10) days, unless absolute majority is met.

 

7.4.3
If such a motion is successful, it leads to compulsory resignation of the said council member.

 

7.4.4
Following a successful no confidence motion the Command Staff will vote to determine if the said Council member is eligible to a Council Emeritus title

 

7.4.5
Any resulting vacancy on the council must be filled according to article
6.2
of the present bylaws.

7.6
No more then one Council member may be the subject of a motion of no confidence at any given time.

 

7.7
At any moment during these proceedings, a Council member may choose to step down from office, thus ending the proceedings.

 

7.8
Prospects, members currently in subject of vote for dismissal from the clan cannot challenge a council member.

 

8. Hierarchy and Clan Structure

 

In order to keep it simple we had to find a way to keep everything organised and strong without all the red tape and the constraints of a strict military style. We therefore adopted a easy concept. Everyone is equal, there are no promotions in ranks as such. There are however position that one might be appointed too, some of those position might give extra access or powers to those members but that is the extent of their effects. Here are the positions or offices already in place.

 

8.1 Member Categories
;

  • Toontown War Council Members
    : Ruling body of the clan must be compose at all times of a minimum of three (3) individuals, but should always contain an odd number of individuals if more than three in order to avoid voting ties. They make the decisions concerning anything related to the bylaws, clan, server rules, position appointment and such. All decisions made by the Toontown War Council will be reached after a majority or unanimous vote depending on the nature of the decision.
  • Departemental
    Officer in Charge
    : Larger departments (see below) will require someone to supervise it's activities. This task will be the responsibility of the OIC of such a deparment. Departemental OIC's are to be considered to be in charge of their department and will anwser to the Toontown War Council.
  • Second in Command
    : Larger departments (see below) will require redundancy in it's activities. The 2IC are official backups to the OIC of a department. They will assist the OIC in any way they can. They can be call upon to be "
    Acting OIC
    " if the OIC takes a leave or is forced away from his duties for a limited time. OIC and 2IC are strongly invited to work in close relationship with each other. Thus taking advantage of everyones skills and knowledge.
  • Command Staff
    : Consists of all Council Members and all OIC / 2IC. Functions as a decision making structure.
  • Departemental Staff
    : Clan members who are part of a department. Can be deputies, animators, orientation officers, liaison officers, watchdogs, regional attachés...
  • Toon
    : Clan members who where implicated in the conception of the clan in it's beginning, or members who have contributed in a major and vital aspect of the clan. Note that this title holds no special powers and is only used as a recognition.
  • Tinytoon
    : Standard clan members who have completed their trial period as prospect.
  • Prospect
    : New clan member that has not yet completed their 30 day trial period.

 

8.2 Departments;

 

Additional duties will be required by some of our members on a voluntary basis, those duties will be the responsibility of various departments who will have specific task to accomplish in order to make this clan whole. In charge of a department can be an OIC (see above), but in the case of small departments with one (1) or two (2) individual such might not be the case. The duties and/or responsibilities of the various departments will be outlined by the present bylaws and can be changed by the Toontown War Council.

 

  • Acme Watchdog
    : Watchdogs are in charge of moderating the forums and monitoring the forums. They will have some additional rights in the forum that might include but are not limited to; Closing topics, marking topics for deletion, warning users for violation of board terms of use, submit forum temp bans and perm bans request to the Council.

     

  • Animation Studio
    : Members of the Animation studio will be responsible for the creation of forum avatars and signatures for members. The animators report to their OIC

     

  • Candy Store
    : The Candy Store and it's staff are tasked with awarding medals, tracking membership aniversaries. They report to an OIC

     

  • Liaison Office
    : A liaison officer or LNO is a person that liaises between two organizations to communicate and coordinate their activities. Liaison Officers organizes scrims, alliances and such related activities.

     

  • Nerd Herd Help Desk
    : Website, forum administrators, game servers, the Nerd Herd are those who make all of this possible. They will have some additional access to the website, databases and all others system required in order to allow them to execute their work.

     

  • Orientation Office
    : Orientation Officers will show prospects how things work around here, going over the rules and regulations with new members, present key elements of our website and where to find things, how to use Team Speak and answer any questions or concerns that may come up along the way for the Prospect. Orientation Officers assist new prospect during their 30 day probationary period transitioning into the Cartoon Generals. Orientation Officers will prepare the prospects for upcoming votes, what will affect their vote, what could hurt your vote and prepare prospects how to become an admin. The Orientation Officers report to their OIC.

     

  • Toontown Sheriff dept.
    : The Sheriff and it's deputies are in charge of making sure our rules are followed on the server, and that admin rights are used appropriately on our game servers. Note that server admin access is not only limited to this office, but they will be responsible for un-ban requests and other duties associated with the server admins! Sheriffs can also submit admin rights removal requests to the Council, for members who have abused of their admin rights! The Deputies report to their OIC, the Sherrif.

  • Follow up on signature requests and ensure that they get completed.
  • Overview and participate in the design new medals, awards and other such recognitions.
  • Discuss needs from the department with the Toontown War Council when required.
  • Any other related task that are required by the department
  • Reports to the Toontown War Council.

CandyStore
:
Candy Store OIC

  • Train Candy Store Staff
  • Overview the everyday activities of the department.
  • Overview and participate in the design new medals, awards and other such recognitions.
  • Discuss needs from the department with the Toontown War Council when required.
  • Any other related task that are required by the department
  • Reports to the Toontown War Council.

Liaison Office
:
Liaison Office OIC

  • Train Liaison Officers
  • Overview the everyday activities of the department.

  • Organize battles, scrims and practices.
  • Act as an ambassador for the clan in various online communites.
  • Participate in the everyday activities of the department.

  • Administer databases, servers and other tools use by the clan.
  • Provide support for clan members for the various tools used by the clan.
  • Participate in the everyday activities of the department.
  • Discuss needs from the department with their OIC when required.
  • Any other related task that are required by the department
  • Reports to their OIC.

Orientation Office

Orientation Officers

  • Show prospects how things are done in the clan.
  • Go over the rules, regulations, website and where to find things.
  • Answer any questions or concerns that may come up along the way for the Prospects.
  • Assist prospects during their 30 day probationary period transitioning into the Cartoon Generals.
  • Prepare prospects for upcoming votes.
  • Prepare prospects on how to use server admin privileges.
  • Participate in the everyday activities of the department.
  • Discuss needs from the department with the OIC when required.
  • Any other related task that are required by the department.
  • Discuss needs from the department with their OIC when required.
  • Reports to the OIC.

Toontown Sheriff dept.
:
Deputies

  • Check and make verification on claims of hacking or rule violations.
  • Participate in the everyday activities of the department.
  • Review kick/ban reports.
  • Review chat logs.
  • Work with
    Orientation Officers
    in cases involving Prospects.
  • Enforce server rules and rules of conduct in all Cartoon Generals servers, including all game servers, teamspeak, forums.
  • Conduct various investigation when required.
  • Discuss needs from the department with the Sherrif.
  • Any other related task that are required by the department
  • Reports to the Sherrif.
